welfare of parents and senior citizens act comes into force

Tribunals in districts for disposal of cases

Bhopal:Thursday, August 27, 2009:Updated 19:10IST The Maintenance and Welfare of Parents and Senior Citizens Act has come into force from the date of its notification on August 23. The Minister of State for Women and Child Welfare (independent charge) Smt. Ranjana Baghel, while elaborating on the provisions of this Act, said that it aims at putting in place a mechanism that would help ensure welfare, rehabilitation and proper care of senior citizens and parents.
According to Smt. Baghel, the Act confers the right on every senior citizen of 60 years of age or more to demand maintenance from those relations who own their properties or who can be successor thereof. A tribunal has been set up in every district for disposal of the cases pertaining to maintenance of aged people.
There will be an appellate tribunal to hear appeals against the decisions of the tribunal. If the tribunal were satisfied that the children or relatives have neglected their parents or senior citizens or have refused to take care of them, it would be able to issue order for payment of maximum Rs ten thousand per month to the applicants.
Smt. Baghel informed that neglect or abandonment of senior citizens is a cognizable offence and the offender can be liable to a five of Rs five thousand or three months imprisonment. She said that the state government would set up Old Age Homes for protection and maintenance of senior citizens.
The state government has taken action for effective enforcement of the Act. Under the provisions of the Act the Madhya Pradesh Maintenance and Welfare of Parents and Senior Citizens Rules 2009 have been enforced by a notification issued on July 2,2009. All the district officers of social justice department have been designate as maintenance officers under these rules.
Smt. Ranjana Baghel informed that the parents and senior citizens who are no able to maintain themselves with their income or earning accruing from their properties could apply for maintenance from their adult children or relatives. The maintenance will include proper food, shelter, clothing and medical facilities. The parents include real, adoptive and step mother or father, whether they are senior citizens or not.
The Minister stressed the need for wide publicity of the Act and the rules for their proper implementation. As part of the publicity posters are being sent to districts soon.
Smt. Baghel has directed all the collectors, joint directors and deputy directors of social justice department posted in districts to take suitable action for effective implementation of the Act so that destitute and neglected aged persons may live a dignified life. She has asked them to give top priority to it.
